1. Introduction & Acceptance of Terms
Welcome to the trail map application created, owned, and operated by Sheffield Children’s Hospital Charity, a working name of The Children’s Hospital Charity, registered charity 505002, England and Wales and a company limited by guarantee (company number 01224751) (“we,” “us,” or “our”). By accessing, registering for, or using this application, or participating in the Pride of Yorkshire trail initiative (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility and Account Registration
The Service is intended solely for users who are thirteen (13) years of age or older.
- Age of Consent: In accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, 13 is the legal age of digital consent for information society services in the United Kingdom. If you are between the ages of 13 and 18, you acknowledge that you possess the capacity to understand these Terms, though we encourage you to review them with a parent or legal guardian. If we discover or have reasonable grounds to suspect that a user is under 13 years of age, we reserve the right to suspend or terminate their account immediately and permanently delete all associated personal data in compliance with our statutory obligations.
- Technical Requirements: To participate in Pride of Yorkshire and collect lions, you will need to create an account, and need access to a supported mobile device, internet location, and have your location services turned on for your browser.
3. Account Security
You agree to provide accurate, current, and complete information during the registration process and to keep this information updated. You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for any and all activities that occur under your account. You agree to notify Sheffield Children’s Hospital Charity immediately of any unauthorised use of your account or any other breach of security. Sheffield Children’s Hospital Charity will not be liable for any loss or damage arising from your failure to protect your account credentials.
4. No-Advertising and Privacy Commitment
Sheffield Children’s Hospital Charity is committed to delivering an uninterrupted user experience focused entirely on trail navigation and outdoor exploration. The Service is provided completely free of third-party commercial advertising.
We do not sell ad space, nor do we deploy targeted marketing tracking networks within the application software. Any processing of your personal data is strictly limited to operations necessary for the performance of this contract (such as account management, internal telemetry, and location tracking for mapping and lion collection) and is conducted in absolute compliance with the UK GDPR, the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations (PECR).

5. Intellectual Property and Permitted Use
The application, including its interface, layout, proprietary trail maps, software code, design, and digital assets (including the Pride of Yorkshire graphics and lions framework), is the exclusive property of Sheffield Children’s Hospital Charity. Subject to your compliance with these Terms, Sheffield Children’s Hospital Charity grants you a personal, non-exclusive, non-transferable, revocable, and limited license to access and use the Service for your personal, non-commercial recreational purposes.
6. Interacting with Others & Prohibited Conduct
By participating in Pride of Yorkshire, you agree to maintain safe and appropriate contact with other players and other people in the real world. You explicitly agree that you will not engage in any behaviour that violates UK law, endangers others, or disrupts the operation of the Service.
Specifically, you agree to the following terms:
- Real-World Conduct: You will not harass, threaten, or otherwise violate the legal rights of others.
- Property Rights: You will not trespass, or in any manner attempt to gain access to any property or location where you do not have the right or permission to be.
- Safety & Liability: You will not otherwise engage in activity that may result in injury, death, property damage, nuisance, or liability of any kind.
- Third-Party Release: If you have a dispute with any third party relating to your participation in Pride of Yorkshire, you release Sheffield Children’s Hospital Charity (and our staff, subsidiaries and partners) from all claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed.
- Technical Integrity: You will not attempt to reverse engineer, decompile, copy, or extract the source code, or attempt to gain unauthorised access to our servers, databases, or networks.
- Fair Play: You will not submit false, misleading, or intentionally inaccurate trail updates, safety hazards, or geographical markers.
7. Assumption of Risk and Safety Disclaimer
TRAIL NAVIGATION AND OUTDOOR ACTIVITIES INVOLVE INHERENT RISKS. The trail maps provided through the Service are intended for general informational and educational purposes only. Environmental conditions, trail layouts, and weather can change rapidly.
You expressly acknowledge and agree that:
- Your use of the trail maps and reliance on any data within the application is entirely at your own risk.
- The Service does not replace the need for proper outdoor safety gear, physical backup maps, compasses, local expertise, and sound personal judgment.
- You are solely responsible for ensuring your physical fitness and preparation match the difficulty of any selected trail.
8. Limitation of Liability and Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHEFFIELD CHILDREN’S HOSPITAL CHARITY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
NOTHING IN THESE TERMS SEEKS TO EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE LAWFULLY EXCLUDED UNDER UK LAW. SUBJECT TO THAT FOREGOING CLAUSE, IN NO EVENT SHALL SHEFFIELD CHILDREN’S HOSPITAL CHARITY, SHEFFIELD CHILDREN’S HOSPITAL CHARITY, THEIR DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DATA LOSS, UTILITY INTERRUPTIONS, OR ACCIDENTS ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.
9. Modification of Terms and Service
Sheffield Children’s Hospital Charity reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the “Effective Date” at the top of these Terms or by sending an in-app notification. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
10. Account Suspension, Termination, and Closure
Suspension or Termination by Us: We may suspend or terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you, including if: (a) you fail to comply with these Terms; (b) we suspect fraud, cheating, or misuse, or (c) we suspect any other unlawful activity associated with your Account.
Account Closure by You: You may request to close your account at any time. Your account closure request must be emailed to sculptures@sheffieldchildrens.org with “ACCOUNT CLOSURE” followed by your name and email address in the subject line.
Data Post-Termination: Upon account closure or termination, your right to use the Service ceases immediately, and your data will be handled, pseudonymised, or permanently deleted in accordance with our UK GDPR-compliant data retention policies.
12. Governing Law and Jurisdiction
These Terms, your use of the application, and any dispute arising out of or related to them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. Any legal action, proceeding, or statutory claim arising under these Terms shall be brought exclusively before the courts of the United Kingdom.
